Acceptable Use Policy
INTRODUCTIONThis statement encompasses a policy for the acceptable use of services provided by Pine Digital Security (Pine). All customers of services provided by Pine must comply with this Acceptable Use Policy (AUP). Pine supports the free flow of information and ideas over the internet and does not actively monitor use of the services under normal circumstances.
Similarly, Pine does not exercise editorial control over the content of any website, electronic mail transmission, news group, or other material created or accessible over or through the services, except when this was created by or for Pine. Pine may, however, remove any material that, in Pine's sole discretion, may be illegal, may subject Pine to liability, or which may violate this AUP.
Pine will cooperate with legal authorities and/or third parties in the investigation of any suspected or alleged crime or civil wrongdoing.
VIOLATIONSThe following points constitute violations of this AUP:
A. Illegal Use
Using the service(s) provided by Pine to transmit any material (by e-mail, uploading, posting, or otherwise) that, intentionally or unintentionally, violates any applicable local, national or international law, or any rules or regulations promulgated there under.
B. Threads
Using the service(s) provided by Pine to transmit any material (by e-mail, uploading, posting, or otherwise) that threatens or encourages bodily harm or destruction of property.
C. Harassement
Using the service(s) provided by Pine to transmit any material (by e-mail, uploading, posting, or otherwise) that harasses another.
D. Copyright or Trademark Infringement
Using the service(s) provided by Pine to transmit any material (by e-mail, uploading, posting, or otherwise) that infringes any copyright, trademark, patent, trade secret, or other proprietary rights of any third party, including, but not limited to, the unauthorized copying of copyrighted material, the digitization and distribution of photographs from magazines, books, or other copyrighted sources, and the unauthorized transmittal of copyrighted software.
E. Fraudulent Activity
Using the service(s) provided by Pine to make fraudulent offers to sell or buy products, items, or services, or to advance any type of financial scam such as "pyramid schemes," "Ponzi schemes," and "chain letters."
F. Forgery or Impersonation
Using the service(s) provided by Pine to deceive or mislead by adding, removing or modifying identifying network header information. Attempting to impersonate any person by using forged headers or other identifying information is also prohibited. The use of anonymous remailers or nicknames does not constitute impersonation. Using deliberately misleading headers ("munging" headers) in news postings in order to avoid spam e-mail address collectors is allowed.
G. Unsolicited Commercial or Bulk E-mail
Using the service(s) provided by Pine to transmit any unsolicited commercial e-mail or unsolicited bulk e-mail. Activities that have the effect of facilitating the transmission of unsolicited commercial e-mail or unsolicited bulk e-mail are also prohibited.
H. Unauthorized Access
Using the service(s) provided by Pine to access, or to attempt to access, the accounts of others, or to penetrate, or attempt to penetrate, security measures of computer software or hardware, an electronic communications system, or a telecommunications system, of Pine or another entity, whether or not the intrusion results in the corruption or loss of data.
I. Collection of Personal Data
Using the service(s) provided by Pine to collect, or attempt to collect, personal information about third parties without their knowledge or consent.
J. Reselling Services
Reselling the service(s) provided by Pine without authorization from Pine.
K. Network Disruptions and Unfriendly Activity
Using the service(s) provided by Pine for activities that adversely affects the ability of other people or systems to use their service(s). This includes DoS (i.e. Denial of Service) attacks against other network host(s) or individual user(s). Interference with, or disruption of, other network users, network services, or network equipment is also prohibited.
L. Co-located Servers and Hosted Applications
If the customer does not have a maintenance contract with Pine, the customer is responsible for a secure configuration of its servers and/or applications that are co-located and/or hosted at Pine. A customer may not, through action or inaction, allow others to use its servers and/or applications that are co-located and/or hosted at Pine for illegal or inappropriate actions. A customer may not permit its servers and/or applications that are co-located and/or hosted at Pine, through action or inaction, to be configured in such a way that gives a third party the capability to use these systems in an illegal or inappropriate manner.
Pine requests that anyone who believes that there has been a violation of this AUP direct the information to the Abuse department, at: abuse@pine.nl. If available, please provide the following information:
- IP address used to commit the alleged violation;
- Date and time of the alleged violation, including the time zone or offset from GMT;
- Evidence of the alleged violation;
- E-mail with full header information provides all of the above, as do "syslog" files. Other situations will require different methods of providing the above information.
Pine may take any one or more of the following actions in response to violations of this AUP:
- Issue warnings: written or verbal;
- Bill for administrative costs and/or reactivation charges;
- Suspend or terminate the service(s);
- Take legal action;
- Collect damages.
Pine reserves the right to revise, amend, or modify this AUP at any time and in any manner. Notice of revisions, amendments, or modifications will be posted on Pine's website www.pine.nl.
